Terms of Service
These Terms of Service govern your use of the LEADER PERFORM website and the services we provide. By accessing our website or submitting an inquiry, you agree to these terms.
Last updated: 12 August 2026
In short
- →This website is for B2B professionals. We don't sell to consumers.
- →Submitting an inquiry creates no contractual obligation on either side — it's an invitation to discuss.
- →Our content is provided “as is” without warranties. We are not liable for indirect or consequential damages.
- →Disputes are resolved under the laws of Sudan and the United Arab Emirates, depending on which office you contract with.
1. Acceptance of Terms
By accessing or using this website, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, please do not use our website or submit an inquiry. These terms apply to all visitors, including prospective clients, partners, and casual browsers.
If you are accessing this website on behalf of a company, you represent that you have the authority to bind that company to these terms, and the term “you” in this document refers to both you personally and the company you represent.
2. Description of Services
LEADER PERFORM provides business-to-business (B2B) outsourcing services, including but not limited to:
- Business Process Outsourcing (BPO)
- Customer Support Services
- Call Center Services (inbound and outbound)
- Technical Support Services
- Email Support Services
- Live Chat Support Services
This website describes our services at a high level for informational purposes. The specific scope, deliverables, service levels, pricing, and terms of any engagement will be governed by a separate written agreement (Statement of Work, Master Services Agreement, or equivalent) signed by both parties. In the event of any conflict between these Terms of Service and a signed agreement, the signed agreement prevails.
We operate from offices in Khartoum, Sudan and the United Arab Emirates. The jurisdiction that applies to any specific engagement depends on which LEADER PERFORM entity contracts with you.
3. B2B Use Only
Our services are offered exclusively to businesses, professionals, and commercial organisations. We do not provide services to consumers. By submitting an inquiry through this website, you represent and warrant that:
- →You are at least 18 years of age and have the legal capacity to enter into contracts.
- →You are acting in a business or professional capacity, not as a consumer.
- →Any information you submit is accurate, complete, and not misleading.
- →You have the right to share any data you submit, and your submission does not violate any third-party rights or applicable laws.
4. Inquiries & Proposals
Submitting an inquiry through our contact form constitutes an invitation to discuss a potential business relationship. It is not an offer, a contract, or a binding commitment. Similarly, any proposal, quote, or scope of work we provide in response is an invitation to negotiate, not a binding offer, unless explicitly stated otherwise in writing and signed by an authorised representative of LEADER PERFORM.
We aim to respond to inquiries within one business day, but we do not guarantee a response time for non-contracted communications. We reserve the right to decline an inquiry without providing a reason.
5. Intellectual Property
All content on this website — including text, graphics, logos, images, software, and the overall look and feel — is the property of LEADER PERFORM or its licensors and is protected by intellectual property laws of Sudan, the United Arab Emirates, and other applicable jurisdictions.

The “LEADER PERFORM” name, logo, and brand marks are trademarks of LEADER PERFORM. Unauthorised use is prohibited.
6. Acceptable Use

- ×Use this website or our services for any unlawful purpose, including but not limited to fraud, harassment, defamation, or the distribution of prohibited content under UAE Federal Decree-Law No. 34 of 2021 on Countering Rumours and Cybercrimes.
- ×Attempt to gain unauthorised access to our systems, user accounts, or data, or interfere with the proper functioning of the website.
- ×Submit content that is defamatory, obscene, threatening, hateful, or that violates the religious, cultural, or political sensibilities of the United Arab Emirates or Sudan.

- ×Submit any content that contains viruses, malware, or other malicious code.
- ×Impersonate another person or entity, or misrepresent your affiliation with a person or entity.

7. Disclaimer of Warranties
This website and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, LEADER PERFORM disclaims all warranties, express or implied, including but not limited to:
- Implied warranties of merchantability and fitness for a particular purpose.
- Warranties of title, non-infringement, or quiet enjoyment.
- Warranties that the website will be uninterrupted, error-free, secure, or free of harmful components.
- Warranties that any information on the website is accurate, complete, or current.
You access this website at your own risk. We are not liable for any damage to your device, data, or business resulting from your use of the website.
Any services we provide under a signed agreement are governed by the warranties explicitly stated in that agreement, which supersede the disclaimers in this section.
8. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall LEADER PERFORM, its officers, directors, employees, or affiliates be liable for:
- →Any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) this website.
- →Any loss of profits, revenue, data, or business opportunity arising from your reliance on information obtained from this website.
- →Any unauthorized access to or alteration of your data, except where caused by our gross negligence or wilful misconduct.
This limitation applies regardless of the legal theory (contract, tort, negligence, or otherwise) and even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under the laws of Sudan or the United Arab Emirates, including liability for fraud, gross negligence, or wilful misconduct.
9. Indemnification
You agree to indemnify and hold harmless LEADER PERFORM, its officers, directors, employees, and affiliates from any claim, demand, loss, or damages — including reasonable legal fees — arising out of:
- Your breach of these Terms of Service.
- Your violation of any applicable law or third-party right in connection with your use of this website.
- Any content or information you submit to us through the contact form or any other channel.
10. Governing Law & Dispute Resolution
These Terms of Service are governed by the laws of Sudan and the United Arab Emirates, depending on which LEADER PERFORM entity you contract with:
- →Sudan office — Khartoum, Sudan. Disputes are resolved under Sudanese law and the exclusive jurisdiction of the courts of Khartoum.
- →UAE office — United Arab Emirates. Disputes are resolved under UAE Federal Law and the exclusive jurisdiction of the courts of the Emirate in which the contracting LEADER PERFORM entity is registered.
Before initiating court proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation for a period of thirty (30) days. If the dispute remains unresolved, either party may initiate proceedings in the competent court of the relevant jurisdiction.
The United Arab Emirates is a signatory to the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards. Where the parties have agreed to arbitration in a signed contract, that agreement supersedes this clause.
11. Regulatory Compliance
Our operations comply with the applicable laws and regulations of Sudan and the United Arab Emirates, including:
- →UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data — see our Privacy Policy for details on how we collect, use, and protect personal data.
- →UAE Federal Decree-Law No. 34 of 2021 on Countering Rumours and Cybercrimes — we do not host, transmit, or facilitate prohibited content.
- →UAE Consumer Protection Law (Federal Law No. 15 of 2020) — note: our services are B2B only; consumer protection regulations do not directly apply, but we adhere to their spirit in all commercial dealings.
- →UAE Telecommunications Regulatory Authority (TRA) & Digital Government guidelines — our website follows accessibility and content guidelines applicable to commercial websites operating in the UAE.
We hold the trade licences and commercial registrations required to operate our business in Sudan and the UAE. Proof of registration is available on request.
12. Third-Party Links
This website may contain links to third-party websites or services that we do not own or control. We are not responsible for the content, privacy practices, or terms of any third-party site. Accessing a third-party link is at your own risk. We encourage you to review the terms and privacy policy of any website you visit.
